{"id":2694,"date":"2023-03-27T12:35:00","date_gmt":"2023-03-27T10:35:00","guid":{"rendered":"https:\/\/gremibcn.com\/revista\/?p=2694"},"modified":"2024-02-29T10:32:20","modified_gmt":"2024-02-29T09:32:20","slug":"la-mejor-defensa-para-el-taller","status":"publish","type":"post","link":"https:\/\/gremibcn.com\/revista\/revista-101-articulo\/la-mejor-defensa-para-el-taller\/","title":{"rendered":"La mejor defensa para el taller"},"content":{"rendered":"<h2>La mejor defensa para el taller<\/h2>\n\n\n<p class=\"maytex\">Hablemos de la apropiaci\u00f3n indebida<\/p>\n\n\n\n<figure class=\"wp-block-image alignleft size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" width=\"1024\" height=\"576\" src=\"https:\/\/gremibcn.com\/revista\/wp-content\/uploads\/LaApropiacionIndebida-101-16x9-min-1024x576.jpg\" alt=\"La mejor defensa para el taller\" class=\"wp-image-2695\" style=\"width:512px;height:288px\"\/><\/figure>\n\n\n\n<p>Desde el <a href=\"http:\/\/gremibcn.com\/taller\/Servicios.asp\" target=\"_blank\" rel=\"noreferrer noopener\">Departamento Jur\u00eddico del Gremio<\/a> nos estamos encontrando un mayor registro de casos de denuncias a talleres por parte del cliente por un <strong><u>delito de apropiaci\u00f3n indebida<\/u><\/strong> (de 6 meses a 3 a\u00f1os de prisi\u00f3n, el delito b\u00e1sico).<\/p>\n\n\n\n<p>Cuando el cliente\/usuario deja un veh\u00edculo en un taller para realizar una reparaci\u00f3n, y una vez realizada la misma el cliente pretende retirar el veh\u00edculo sin pagar la factura de reparaci\u00f3n, el taller tiene <b>derecho de retenci\u00f3n y debe formalizar este derecho<\/b>. Ante esta situaci\u00f3n el cliente interpone una denuncia contra el titular del taller por un delito de apropiaci\u00f3n indebida (gratis para el cliente, pero no siempre r\u00e1pido).<\/p>\n\n\n\n<p>Normalmente estas denuncias, que se tramitan en un proceso penal, despu\u00e9s de prestar declaraci\u00f3n el titular del taller ante el Juez, el procedimiento suele ser archivado mediante Auto de Sobreseimiento, ya que el juez en la parte de razonamientos jur\u00eddicos de dicho Auto indica: \u201c<em>De lo actuado no aparece debidamente <b>justificada la perpetraci\u00f3n del delito<\/b> que ha dado motivo a la formaci\u00f3n de la causa.\u201d<\/em><\/p>\n\n\n\n<p>Para que se perpetre el delito de apropiaci\u00f3n indebida es necesario que se den algunos elementos del tipo del delito tanto subjetivos como objetivos, que en el marco de un contrato civil no se dan. Por eso <b>mayoritariamente el Juez archiva el procedimiento penal<\/b> para que se discuta el conflicto en la jurisdicci\u00f3n civil con la oportuna demanda de reclamaci\u00f3n de cantidad.<\/p>\n\n\n\n<p>No obstante, <strong>para la defensa del taller en sede penal<\/strong> y conseguir en cu\u00e1nto antes un archivo de la denuncia <b>es important\u00edsimo disponer de documentaci\u00f3n no unilateral<\/b>, es decir, firmada por el cliente o en la que \u00e9ste ha participado el cliente o un tercero, para aportar pruebas de que el conflicto con el cliente es un tema civil y no un tema penal. Por ejemplo:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Comprobante de gr\u00faa.<\/li>\n\n\n\n<li>Orden de reparaci\u00f3n (firmada correctamente, incluso indicando los gastos de estancia en caso de no retirada y el d\u00eda previsto de entrega). <em>Seg\u00fan la jurisprudencia no procede condicionar la retirada del veh\u00edculo a pagar los gastos de estancia por dep\u00f3sito forzoso del veh\u00edculo.<\/em><\/li>\n<\/ul>\n\n\n\n<p>Con la Orden de reparaci\u00f3n <b>firmada<\/b> tenemos la aceptaci\u00f3n por parte del cliente conforme deposita el veh\u00edculo dentro de las instalaciones del taller y autoriza la reparaci\u00f3n.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Presupuesto de reparaci\u00f3n.<\/li>\n\n\n\n<li>Comunicaciones con el cliente inform\u00e1ndole del proceso de reparaci\u00f3n o de cualquier contratiempo y\/o novedad (conversaciones WhatsApp, emails, etc\u2026).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">\u00bfQue podemos hacer si el cliente pretende retirar el veh\u00edculo sin pagar la factura de reparaci\u00f3n?<\/h2>\n\n\n\n<p>En el resto de Espa\u00f1a el art. 1600 del <a href=\"https:\/\/boe.es\/buscar\/act.php?id=BOE-A-1889-4763&amp;p=20180804&amp;tn=1\" target=\"_blank\" rel=\"noreferrer noopener\">codigo civl<\/a> indica que:<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"879\" height=\"104\" src=\"https:\/\/gremibcn.com\/revista\/wp-content\/uploads\/Imagen1-min.png\" alt=\"La mejor defensa para el taller\" class=\"wp-image-2742\"\/><\/figure>\n\n\n\n<p>En Catalu\u00f1a, tambi\u00e9n existe el derecho de retenci\u00f3n pero hay unas formalidades que cumplir. El art. 569.3 del C\u00f3digo Civil Catalan indica que:<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"879\" height=\"135\" src=\"https:\/\/gremibcn.com\/revista\/wp-content\/uploads\/Imagen2-min.png\" alt=\"La mejor defensa para el taller\" class=\"wp-image-2743\"\/><\/figure>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"879\" height=\"316\" src=\"https:\/\/gremibcn.com\/revista\/wp-content\/uploads\/Imagen3-min.png\" alt=\"La mejor defensa para el taller\" class=\"wp-image-2744\"\/><\/figure>\n\n\n\n<p><b><u>Se puede retener<\/u><\/b> un veh\u00edculo como garant\u00eda de pago, <b><u>pero debe existir \u201cpresupuesto escrito y aceptado\u201d previo<\/u><\/b>, adem\u00e1s de realizar la notificaci\u00f3n al cliente, ya sea notarialmente o por burofax seg\u00fan el valor del veh\u00edculo;<\/p>\n\n\n\n<p>En este contexto, es interesante explorar la negociaci\u00f3n sin necesidad de formalizar la retenci\u00f3n del veh\u00edculo.
