Por ser <strong><a href=\"https:\/\/gremibcn.com\/associat\/\" target=\"_blank\" rel=\"noreferrer noopener\">taller agremiado<\/a><\/strong> puede ofrecer a su cliente el servicio de <strong>abogado gratuito<\/strong> y as\u00ed poder realizar la reparaci\u00f3n del veh\u00edculo con la calidad adecuada, evitando indemnizaciones injustas y\/o que la compa\u00f1\u00eda lo declare siniestro total impidiendo que el perjudicado pueda resarcirse del da\u00f1o material sufrido.<\/p>\n\n\n\n<p>Los casos se pueden clasificar en dos tipos:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Caso 1: Si su cliente no ha sido el culpable del <strong>siniestro de circulaci\u00f3n<\/strong>, tiene derecho a que, el conductor culpable y la aseguradora de \u00e9ste, le indemnice con una cantidad econ\u00f3mica que le reponga en la situaci\u00f3n anterior al siniestro; es decir, dejar el veh\u00edculo en las condiciones anteriores al siniestro. En este caso, el debate est\u00e1 en determinar esa justa cantidad econ\u00f3mica, de manera que no sea ni insuficiente ni excesiva (lo que llevar\u00eda al enriquecimiento injusto; es decir, que el cliente saque \u2018provecho\u2019 del siniestro).<\/li>\n\n\n\n<li>Caso 2: Si su cliente ha sido el <strong>culpable del siniestro de circulaci\u00f3n<\/strong>, tiene derecho a que su aseguradora le indemnice si ha contratado esa cobertura en su p\u00f3liza de seguro y en las condiciones pactadas.
